Summary: these terms set out the deal between you and 10gbpsservers.com. Pay for your service, use it lawfully, and we will keep it online on the network we advertised. Capitalised terms have the meanings given in section 2.
These Terms of Service govern all services provided by [Company Name] ("we", "us", "our") through the website 10gbpsservers.com and the associated client area. By placing an order, or by continuing to use a service, you accept these terms on behalf of yourself and any organisation you represent. If you do not agree with them, do not order.
"Service" means any dedicated server, virtual private server, bandwidth, IP address or related facility we provide. "Customer", "you" and "your" mean the person or entity named on the account. "Client Area" means the billing and control platform at 10gbpsservers.com/client. "AUP" means our Acceptable Use Policy, which forms part of these terms.
We provide dedicated server, virtual private server and related hosting services. Hardware, bandwidth and location descriptions published on the website are accurate to the best of our knowledge at the time of publication. Where a listed configuration is unavailable, we may supply an equivalent or better configuration at the same price and will inform you before provisioning.
Orders are activated once payment has been received and verified. We may request additional identity or address verification for orders that our fraud screening flags, and may decline or cancel an order we cannot verify. Virtual services are normally provisioned automatically; dedicated hardware is provisioned manually and may take several hours. Any stated delivery time is an estimate, not a guarantee.
All prices are stated in US dollars (USD) unless otherwise indicated and are exclusive of any applicable taxes, which are added where we are required to collect them. Fees are billed in advance on a monthly or annual basis. Services not paid by the due date may be suspended and, after a further period, terminated and their data deleted.
We accept major credit and debit cards, PayPal and selected cryptocurrencies through our billing platform. Services renew automatically until cancelled. Invoices are issued in advance of each renewal date and you are responsible for keeping your payment details current and for monitoring the email address on the account.
You must comply with our Acceptable Use Policy. In summary, you may not use our services to send unsolicited bulk email, host or distribute illegal content, infringe intellectual property rights, conduct network attacks or port scanning, distribute malware or phishing material, or violate the acceptable use requirements of the underlying data centre provider. We may suspend or terminate services that breach this section, with or without notice, and without refund in cases of serious abuse.
"Unmetered" refers to traffic volume on the port described for your plan; it does not permit saturating shared infrastructure in a way that degrades service for other customers. Port speed, storage and RAM limits are as stated in your order. Sustained abuse of shared paths may result in traffic shaping after we have contacted you.
IP addresses are allocated to you for the duration of the service and remain our property, reassignable on termination. Additional IPv4 space is provided subject to justification and availability. Reverse DNS entries are configurable by you from the client area for most plans.
Where we supply an operating system or control panel licence, it is licensed to you under the terms of the respective vendor and is valid only while the underlying service is active. You are responsible for holding valid licences for any additional commercial software you install.
We target 99.9% network availability each calendar month, excluding scheduled maintenance and events outside our reasonable control. Where a service level agreement applies, service credits are the sole remedy for any shortfall and must be requested within thirty days of the incident.
Support is provided by ticket and live chat through the client area, staffed by engineers 24 hours a day. Support covers the network, hardware and platform. Support does not include configuration of third-party applications, code debugging or system administration on your behalf unless a managed service has been purchased separately.
You are responsible for maintaining independent backups of your data. Unless a managed backup service is purchased separately, we do not guarantee the recovery of data stored on your service, and we accept no liability for data loss.
You are responsible for the security of your server, including keeping software patched, using strong credentials and restricting access. You must not share access credentials with third parties in a way that permits them to breach the AUP. You must notify us promptly if you believe your service has been compromised.
We may suspend or terminate a service immediately where required to protect the network, to comply with law or to prevent harm to third parties. Non-payment, AUP violations and fraudulent orders are grounds for termination. On termination your data may be irrecoverably deleted after any applicable retention period.
Services renew automatically until cancelled. Cancellation requests must be submitted through the client area before the next renewal date. Setup fees and one-off charges are non-refundable. Refunds, if granted, are issued at our discretion and in accordance with the refund policy published in the client area.
You may export your data at any time while the service is active. We will assist with migrations to or from our platform on a reasonable-efforts basis, but are not responsible for data loss during migration or for recreating configurations we did not deploy.
To the maximum extent permitted by law, our total liability arising out of or relating to the services is limited to the fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental or consequential losses, including lost profits, lost revenue or lost data.
You agree to indemnify us against claims, losses and reasonable costs arising from your use of the services, your content, or your breach of these terms or the AUP, including claims brought by third parties whose rights you have infringed.
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, power or fibre outages, upstream carrier failures, cyber-attacks, or government action.
We may update these terms from time to time. Material changes will be published on this page and, where appropriate, notified by email before they take effect. Continued use of the services after publication constitutes acceptance.
These terms are governed by the laws of the jurisdiction in which [Company Name] is registered, without regard to conflict-of-law rules. Before starting formal proceedings, both parties agree to attempt to resolve the dispute in good faith by written notice and a period of negotiation.
If any provision of these terms is found unenforceable, the remaining provisions continue in full force. These terms, together with the AUP, the Privacy Policy and your order confirmation, form the entire agreement between us and supersede any prior discussion.
